What barristers can raise early, and what can be done later.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\"><span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">A judgment&#039;s life after the case ends<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">I should say at the outset that I&#8217;m not a lawyer. I advise private clients and executives on how they appear online, so I come to this subject from the client&#8217;s side of the screen. What follows describes what tends to happen to people after a judgment is handed down. What the law requires, and what you should advise, are matters for you, and I have left them there.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">The subject is simple to state. A judgment is written for the parties, the court and the profession. Once published, it is also read by a much larger audience, for much longer, and increasingly by software that summarises it.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">How a judgment reaches the public<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Judgments are no longer hard to find. Find Case Law, the National Archives&#039; summaries service, launched in April 2022 with the stated aims of giving the public free access to judgments and preserving them permanently as digital public records. [1] It sits alongside BAILII, which by 2022 had offered free access for more than twenty years, and the commercial publishers.[1]<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Once a judgment is published, it rarely stays in one place. Free services, commercial databases, news reports, commentary and law firm summaries can all carry it or describe it, and some of those will be picked up by search engines. How each is indexed varies, so I would check rather than assume.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">What the client sees in search results<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">For a private client, this tends to mean that a judgment or a write-up of it appears when someone searches their name. That someone might be a prospective business partner, a lender, a new employer, a journalist or a neighbour.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">The judgment may be accurate and fair, and decided in the client&#8217;s favour. It&#8217;s still a long, detailed account of a difficult period in their life, written in terms the reader might not follow.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">What AI assistants add<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">AI assistants add a second layer. A person who once scrolled through search results might now simply ask an assistant for a short account of someone. I would not claim to know how any particular assistant chooses or weighs its sources.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">But material that&#8217;s publicly available online is plainly within their reach, and in the nature of summaries, nuance goes out first. A finding on one narrow issue can end up as a sentence about the person. A claim that failed can sound like an allegation that stuck.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">What clients rarely understand before trial<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Most private clients come to a hearing thinking about the result. Very few have been asked to think about the record. Three points seem to be missed more than any others.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">A public hearing means a lasting record<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">CPR 39.2 sets the general rule that hearings are in public, and a hearing may not be held in private simply because the parties consent.[2] Clients often assume the matter is between the parties and the judge. In a practical sense, that&#8217;s true only until the judgment is published.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Winning does not remove it<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">The judgment in a case the client won is no less searchable than one they lost. The facts that had to be set out to reach the result are still set out. Clients who win are sometimes surprised to find that the document says as much about them as it would have done if they had lost. <span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Anonymity has to be sought at the time<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">The rule on non-disclosure of identity is worded narrowly: The court must order it if, and only if, it considers it necessary to secure the proper administration of justice and to protect the person&#039;s interests.[2] That is a question for the live case.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">NT1 and NT2 v Google shows what it can look like when it is dealt with early. The claimants were anonymised so that the proceedings would not give the information the very publicity they wished to limit, and the judge prepared separate private judgments containing details that could identify them.[3]<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">I mention it only to illustrate the point about timing. A client who raises anonymity for the first time after judgment is in a different position, and I would leave you to say how different.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">What can and cannot be done afterwards<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Clients who contact us after the event usually want to know whether the judgment can be taken down. The honest answer is that the judgment itself generally stays where it is, and the options that remain are narrower and less certain than most people hope.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Anonymisation after publication<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">This is the first option clients ask about, and it&#039;s your territory rather than mine. My understanding is that courts attach considerable weight to open justice. Whether an application is worth making is for counsel to say. <span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Delisting requests to search engines<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Delisting is a different thing.  The origin is Google Spain, decided by the Court of Justice of the EU in 2014, where the Grand Chamber held that individuals could ask a search engine to remove results from a search on their name that were inadequate, irrelevant or excessive, even where the underlying publication was lawful.[4] <span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">English courts considered the idea in NT1 and NT2 v Google in 2018. NT2&#039;s claim succeeded, and NT1&#039;s did not.[3] I find the pairing useful because it shows how dependent on the facts the exercise is.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">The judge also noted that a successful delisting does not remove the information; it may remain available through other searches.[3]<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">The legal framework has moved since 2018, and you will know it far better than I do. What I can describe is the client&#039;s experience. Delisting concerns names and search results; it is not guaranteed, and the judgment stays where it is. <span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">I would not assume that a delisting from one search engine changes what an AI assistant says, and clients should not be promised that it will.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Publishing accurate context<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">The third route is the least dramatic and, I think, the most often overlooked. This might be a short, factual statement on the client&#039;s own site or a reputable outlet saying what the case was about, what was decided and what has happened since. <span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">It cannot remove a judgment. It can give a reader, and a summarising tool, a second accurate source to set beside it.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">It needs care. A statement that sounds aggrieved, or that appears to dispute the court&#8217;s findings, can attract more attention than the judgment ever did. Counsel should see it before it goes up. <span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Why raise it early<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Timing is the reason<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Barristers are well placed to raise this because of timing. The options that are clearly open to a client are mostly open before or during the case. Afterwards, they narrow to routes that are slower and less certain, and a client who learns that from a search result tends to feel they should have been told.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">I am not suggesting a lecture in an already full conference. A question or two at the outset is enough. It lets the client decide with their eyes open whether to proceed, whether to settle, and whether to raise anonymity while the case is live.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Some will decide the record doesn&#8217;t matter to them. That&#8217;s their decision, and it&#8217;s better made early.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Questions counsel might ask at the outset<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">If you search your own name today, what comes up, and are you comfortable with it?<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Would a public judgment about this dispute affect your work, your family or your plans in five years&#039; time?<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Is there anything in this case that you would not want a stranger to find?<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">If you win, would you still be comfortable with the judgment being read in full online?<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">Would you like to talk about anonymity or settlement before we go further?<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">None of this changes the case. It changes what the client knows when they decide to go ahead.<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">A record clients can plan for<span class=\"sf-dump-default sf-dump-ns\">\\r\\n<\/span><\/span>\n    <span class=sf-dump-str title=\"9579 characters\">A judgment will always be a public document, and I do not suggest otherwise. My point is narrower. Clients cope well with a record they expected and badly with one they did not. If counsel can open that conversation early, the client can weigh the cost of a public hearing before it is incurred, rather than discover it later in a search result.
